These Terms of Service (“Terms”) govern access to and use of AnnieKart’s website, application, marketplace, products, services and related features (collectively, the “Services”). By accessing the Services, creating an account, placing an order or otherwise using AnnieKart, you agree to these Terms, together with the applicable Privacy Policy, Return/Replacement/Refund Policy, Shipping Policy, product-specific terms and other policies displayed on the Services.
AnnieKart may operate as an inventory seller, marketplace or facilitator and may offer products supplied by AnnieKart or by third-party sellers, resellers, suppliers, brands or fulfilment partners. The identity and role of the relevant seller may be shown on the product page, invoice or order information.
Nothing in these Terms is intended to exclude or restrict any mandatory right or remedy available under applicable Indian law.
You must provide accurate information when creating an account or placing an order. You are responsible for maintaining the confidentiality of your login credentials and for activities carried out through your account, subject to applicable law.
We may refuse registration, suspend, restrict or terminate an account where reasonably necessary to prevent fraud, abuse, unlawful activity, security risks or repeated violations of these Terms, subject to applicable law and any mandatory consumer rights.
Displaying a product, price or availability on AnnieKart does not necessarily constitute an unconditional offer to sell. An order placed by you is a request to purchase. AnnieKart or the relevant seller may accept, reject or cancel an order in accordance with applicable law and these Terms.
An order may be cancelled or declined for reasons including stock unavailability, pricing or listing error, suspected fraud, payment failure, delivery limitations, seller/fulfilment issues, legal restrictions or other genuine operational reasons. Where required, amounts actually paid for a cancelled order will be refunded through the applicable payment method or another lawful method.
We aim to keep product titles, descriptions, images, specifications, colours, dimensions, prices and availability reasonably accurate. Minor differences may occur due to screen settings, manufacturing variations, packaging changes, photography or supplier updates.
Product-specific instructions, warnings, warranty terms, compatibility requirements and restrictions displayed on the product page or packaging may apply in addition to these Terms.
Prices may change from time to time. The price and charges applicable to an order will generally be those displayed at checkout or otherwise confirmed for that order, subject to correction of genuine errors and applicable law.
Applicable taxes, shipping fees, handling charges, platform/service charges or other disclosed charges may apply. If a material pricing or listing error is discovered, AnnieKart may cancel the affected order and refund amounts paid, subject to applicable law.
Payments may be processed through third-party payment gateways, banks, UPI providers, card networks, wallets, cash-on-delivery partners or other payment methods offered on the Services.
You must use a payment method lawfully available to you and provide accurate information. AnnieKart may place an order on hold or cancel it if payment is unsuccessful, reversed, disputed or reasonably suspected to be unauthorised or fraudulent.
Third-party payment providers may have their own terms and privacy practices.
Delivery estimates are indicative unless expressly stated otherwise. Delays may occur due to logistics conditions, weather, strikes, public restrictions, address issues, failed delivery attempts, seller/warehouse delays or other circumstances outside AnnieKart’s reasonable control.
You are responsible for providing a complete and accurate delivery address and for reasonable cooperation with delivery attempts. Additional charges may apply where a customer-requested change, re-shipment or re-delivery creates additional cost, subject to the applicable Shipping and Return/Replacement/Refund Policies.
Where a package appears materially damaged, opened or tampered with, you should document the condition and notify AnnieKart promptly. For wrong, damaged, missing, materially different or similar claims, the Return/Replacement/Refund Policy may require an unboxing video and other evidence. Failure to provide requested evidence may make verification difficult and may affect claim approval, subject to applicable law.
Returns, replacements, exchanges and refunds are governed by AnnieKart’s current Return, Replacement & Refund Policy and any product-specific terms. Those policies form part of these Terms.
Unless a longer period is expressly stated or required by applicable law, product-condition, return, replacement and exchange claims must be raised within the applicable period stated in the Return/Replacement/Refund Policy.
Customer-requested returns or exchanges, including change-of-mind or size/fit requests, may involve return shipping, reverse logistics, pickup and re-shipping charges as disclosed in the applicable policy, subject to applicable law.
AnnieKart may ordinarily provide only one replacement against an original order/product where the applicable policy permits replacement. This does not exclude any mandatory statutory remedy.
Where a product is supplied by a third-party seller, reseller, supplier or brand, additional seller or manufacturer terms may apply. AnnieKart may coordinate fulfilment, customer support, returns or refunds depending on the transaction structure.
Third-party terms cannot override mandatory consumer rights or obligations imposed on AnnieKart or the relevant seller by applicable law.

To protect customers, sellers and AnnieKart, we may conduct reasonable verification of accounts, orders, payments, delivery records, returns and replacement claims. This may include checking order history, product identifiers, serial numbers, barcodes, package condition, shipment weight, photographs, videos, device or transaction signals and other relevant evidence.
Where we reasonably suspect fraud, abuse, product swapping, unauthorised payment or other misuse, we may delay processing, request additional information, restrict an account, cancel an order, refuse a non-mandatory benefit or take other lawful protective action.
Promotional offers, coupon codes, referral benefits, discounts and free gifts may have additional terms, eligibility conditions, validity periods and usage limits. Unless expressly stated otherwise, promotions may not be combined, transferred, exchanged for cash or used after expiry.
AnnieKart may correct or withdraw a promotion where required because of technical error, misuse, fraud or other legitimate operational reasons, subject to applicable law.
The AnnieKart name, logo, website/app design, text, graphics, photographs, product content created by AnnieKart, software, databases and other original materials are owned by or licensed to AnnieKart and are protected by applicable intellectual-property laws.
You receive a limited, non-exclusive, non-transferable and revocable permission to use the Services for personal and lawful shopping purposes. No ownership rights are transferred to you.
If you submit reviews, ratings, photographs, videos, feedback or other content, you represent that you have the necessary rights to submit it and that it does not unlawfully infringe another person’s rights.
To the extent permitted by law, you grant AnnieKart a non-exclusive, royalty-free, worldwide licence to host, reproduce, display, adapt and use submitted content for operating, improving, moderating and promoting the Services, subject to the Privacy Policy and applicable law.
AnnieKart may remove or restrict content that it reasonably considers unlawful, abusive, misleading, infringing, fraudulent or inconsistent with the Services.
Reviews and ratings should reflect genuine experiences. Fake, manipulated, incentivised without appropriate disclosure, abusive, defamatory or irrelevant reviews may be moderated or removed where permitted by law.
AnnieKart does not guarantee that every review represents the views of AnnieKart or that reviews are complete or independently verified.
We aim to keep the Services available and functional but do not guarantee uninterrupted or error-free availability. Maintenance, upgrades, outages, cyber incidents, third-party failures and other circumstances may temporarily affect access.
The Services may integrate with or link to third-party websites, payment providers, logistics systems, social platforms or other services. AnnieKart does not control independent third-party services and is not responsible for their separate terms, content or privacy practices.
To the maximum extent permitted by applicable law, the Services are provided on an “as available” basis. AnnieKart does not guarantee that the Services will always be uninterrupted, error-free or completely secure.
Nothing in these Terms excludes or limits a warranty, consumer right, product liability obligation or other protection that cannot lawfully be excluded or limited under applicable law.
To the maximum extent permitted by applicable law, AnnieKart will not be liable for indirect, incidental, special or consequential losses arising from use of the Services where such exclusion is legally permissible.
Any limitation of liability is subject to mandatory consumer protection, product liability, statutory compensation, fraud, wilful misconduct or other obligations that cannot legally be excluded or limited.
Where a limitation is legally permitted, AnnieKart’s aggregate liability in relation to a particular transaction will not exceed the amount actually paid by the customer for the affected product or service, except to the extent a different limit is required by applicable law.
To the extent permitted by applicable law, you agree to indemnify and hold harmless AnnieKart and its officers, employees, affiliates and service providers from third-party claims, losses, liabilities and reasonable costs arising from your unlawful use of the Services, fraud, intentional misuse, infringement of third-party rights or material breach of these Terms.
This clause does not require you to indemnify AnnieKart for losses caused by AnnieKart’s own non-excludable legal obligations, fraud or wilful misconduct.
AnnieKart may suspend, restrict or terminate access to an account or Services where reasonably necessary for security, fraud prevention, unlawful activity, abuse, repeated policy violations, non-payment or operational reasons, subject to applicable law.
Termination does not automatically cancel obligations or rights that by their nature should survive, including payment obligations, intellectual-property provisions, dispute provisions, lawful retention obligations and applicable limitations.
Personal information is handled in accordance with AnnieKart’s Privacy Policy. The Privacy Policy forms part of these Terms.
These Terms are governed by the laws of India, subject to mandatory consumer protections and other rights that cannot lawfully be excluded.
Customers are encouraged to first contact AnnieKart through its grievance/customer-support channel so that the matter can be reviewed and, where appropriate, resolved.
To the maximum extent permitted by applicable law, disputes concerning the commercial relationship with AnnieKart may be subject to the courts or competent forums having jurisdiction in Delhi, India. This clause does not deprive a consumer of any jurisdiction, forum or remedy expressly available under applicable Indian consumer-protection legislation.

If any provision of these Terms is held invalid, unlawful or unenforceable, that provision will be modified or severed to the minimum extent necessary, and the remaining provisions will continue to the extent permitted by law.
Failure by AnnieKart to enforce a provision on one occasion does not constitute a waiver of its right to enforce that provision later.
These Terms, together with the Privacy Policy, Return/Replacement/Refund Policy, Shipping Policy, product-specific terms and other policies expressly incorporated into them, form the agreement governing use of the Services, subject to applicable law.
Before publication, AnnieKart should ensure that the legal entity name, registered address, grievance details, seller disclosures, payment information, product-specific terms and other mandatory e-commerce information shown on the website/app are accurate and consistent with the actual business structure.
By using AnnieKart, creating an account or placing an order, you confirm that you have had an opportunity to review these Terms and the related policies. You understand that product-specific terms, shipping terms, return/replacement/refund rules and seller/brand warranties may apply to particular transactions. Nothing in this acknowledgement removes mandatory rights provided by applicable Indian law.
